The bankrupt, together with 0'C., H., F., S. and A. jointly and severally
guaranteed payment by their principal, Her Majesty's Theatre Company, of
3000l. to the appellant bank; the bankrupt, 0'C., H. and S. jointly and severally guaranteed payment by the same principal of a further sum of 2000l., and the bankrupt, O'C., H., F. and S. jointly and severally guaranteed payment by the same principal of a further sum of 1250l. Held, on appeal (The Chief Justice dissenting), affirming the decision of Manning, J., that the transaction amounted to a payment to the bank of 3000l., and that the proof of the bank must be reduced by that amount. |
