Title Aarons v Lewis [1877] VicLawRp 42; (1877) 3 VLR (E) 234 (27 November 1877)
Abstract/Description Under a covenant by a lessee of a theatre to produce books to the lessor as evidences of his accounts, he is impliedly bound to keep books giving reasonable information. A covenant by the lessee of a theatre to afford the lessor, his heirs and assigns, every facility for ascertaining the correctness of accounts rendered by the lessee, cannot be restricted to the lessor, his heirs and assigns, in person; " affording every facility" would include the permitting this to be done by an agent appointed by him or them. "Facility to ascertain correctness of accounts" includes the ascertainment of facts before the account, with which the account if true should correspond.
