Whether the industrial agreement made by the defendant Musicians' Union while the said union was improperly registered as an organization is now valid and binding upon the defendant organization. Whether the High Court of Australia has jurisdiction to restrain the said organization by injunction from instituting proceedings against the plaintiff company in respect of industrial matters in the Commonwealth Court of Conciliation and Arbitration even though the institution of the said proceedings is in violation of the said agreement. |
